Appendix: Withdrawal Form

§1. Definitions

For the purposes of these Regulations, the following terms shall have the following meanings:

  1. Service Provider – KOMBA Maciej Włodarczak, Tax ID (NIP): PL777-288-21-91, registered office address: 62-080 Tarnowo Podgórne, Poland, email: contact@srting.com
  2. Service Recipient / User – a natural person, legal person, or organizational unit using the Service.
  3. Consumer – a natural person performing a legal act not directly related to their business or professional activity.
  4. Entrepreneur with consumer rights – a natural person concluding a contract directly related to their business activity, when the content of the contract shows that it does not have a professional character for that person.
  5. Service / SRTing – a tool enabling automated generation of transcriptions/subtitles based on audio tracks in the Adobe Premiere Pro environment.
  6. Contract – an agreement for the provision of electronic services concluded under the terms specified in the Regulations.
  7. Digital Service – a digital service within the meaning of the Consumer Rights Act.
  8. Platform – the extension (CEP plugin) for Adobe Premiere Pro and related infrastructure.
  9. Account – the User's individual profile in the SRTing system, enabling use of the Service.
  10. Plan – chosen variant of the Service (Free, Starter, Pro, or Enterprise) defining the parameters of Service provision.
  11. Billing Period – a period of 1 month for which the subscription fee is charged and for which the Limit is granted.
  12. Limit – the number of transcription seconds available in a given Billing Period under the Plan.
  13. Balance – the remaining number of Limit seconds in the current Billing Period.
  14. Per-second Billing – billing model within the Limit where usage is calculated for every second of audio material.
  15. Payment Provider – external provider handling payments (e.g., payment gateway), operating under their own regulations.
  16. Reseller / Seller – Paddle.com Market Ltd, acting as the Merchant of Record, responsible for sales, payment processing, and invoicing the User.

§2. Scope of Services

  1. The SRTing Service is a tool enabling automated generation of transcriptions/subtitles based on audio tracks in Adobe Premiere Pro. The Service does not include linguistic, editorial, or substantive correction of the transcription.
  2. Transcription effectiveness and quality depend in particular on recording quality, accent, background noise, and other source material characteristics. The Service Provider does not guarantee a specific level of accuracy.
  3. The Service supports multiple languages. The current scope of supported languages is available in the documentation.
  4. Audio processing takes place locally on the User's computer via a dedicated CLI module. Audio is not sent to the Service Provider's servers.
  5. Diagnostic logs voluntarily provided by the User are stored for the period necessary to resolve the technical issue, no longer than 30 days, and then deleted. The User agrees not to include sensitive data (e.g., passwords, third-party personal data) in the logs.
  6. Only the following are exchanged with the Service Provider's cloud service:
    • authentication data (login),
    • Balance status information,
    • transcription metadata (audio duration, not content).
  7. As part of technical support, the User may voluntarily provide diagnostic logs to the Service Provider. Logs may contain technical information (e.g., plugin version, system, error messages), but do not include the content of processed audio.

§3. Technical Requirements

  1. To use the Service, the following are required:
    • computer with Windows 10/11 meeting Adobe Premiere Pro requirements,
    • Adobe Premiere Pro CC 2020 or newer,
    • active Internet connection required for login, balance verification, and billing,
    • current version of the SRTing plugin and CLI module,
    • email account and browser enabling access to the account panel (if applicable).
  2. The Service Provider may publish minimum technical requirements in the documentation and update them in case of changes by Adobe or operating systems.
  3. To maintain compatibility with Adobe Premiere Pro or OS updates, installation of plugin or CLI module updates may be necessary. Failure to update by the User may result in limited Service functionality.
  4. The Service Provider may provide updates necessary to maintain Service conformity with the Contract; the User should install them immediately upon availability, unless they cause loss of functionality or User data.
  5. The Platform is not a store for ready-made digital products, but a tool (SaaS) for processing audio data provided by the User.
  6. Important: The SRTing Service is auxiliary and informational in nature. The Service is not intended for uses requiring certified, official, or guaranteed accuracy, specifically for evidentiary, legal, judicial, administrative, medical, or diagnostic purposes.
  7. Transcription results generated using the Service may contain errors and should be verified by the User before further use.
  8. The Service Provider is not liable for consequences of using the transcription as the sole or decisive basis for decisions, documents, or actions of a legal, medical, or official nature.

§4. Registration and Account

  1. Use of the Service requires creating an Account by providing an email address and password.
  2. The User agrees to provide true data and maintain the confidentiality of access credentials.
  3. Accepting these Regulations during registration constitutes the conclusion of a Service Agreement.
  4. New Users may be granted a one-time 5 minutes (300 seconds) of free transcription within the Free Plan. Free seconds are granted only for new devices – the system verifies the unique hardware identifier (UUID) of the computer. The UUID is processed only in the form of an irreversible cryptographic hash – the Service Provider does not store or have access to the original hardware identifier. The hash is used solely to prevent promotional abuse (creating multiple accounts to obtain free seconds) and is retained for the duration of Account activity plus 12 months after Account deletion. If an Account is created on a device that was previously associated with another Account, free seconds will not be granted. The Free Plan is not a paid service, does not auto-renew, and free seconds are not exchangeable or refundable.
  5. The User may hold only one Account. Creating multiple accounts to reuse free seconds is prohibited and grounds for Account blocking. A User whose Account has been blocked has the right to appeal the decision via the complaint procedure described in §11. The block may be temporary (up to 30 days for clarification) or permanent.
  6. After concluding the Contract, the Service Provider provides the Consumer with confirmation of Contract conclusion on a durable medium (e.g., via email) within a reasonable time, at the latest before the commencement of Service provision.
  7. The Regulations are made available free of charge in a way that allows their acquisition, reproduction, and recording (e.g., saving or printing) before concluding the Contract.

§5. Conclusion and Termination of Contract

  1. The Contract is concluded for an indefinite period upon Account creation.
  2. The User may terminate the Contract at any time by submitting a request to delete the Account to the Service Provider's email address: contact@srting.com
  3. The Service Provider may verify the User's identity before deleting the Account (e.g., by confirmation from the email address assigned to the Account).
  4. Account deletion does not mean deletion of data that the Service Provider is obliged to store under legal regulations (e.g., accounting records), in accordance with the Privacy Policy.
  5. The Service Provider may suspend access to the Account or terminate the Contract with immediate effect in case of gross violation of the Regulations, in particular:
    • attempts to bypass the billing system,
    • promotional abuse (multiple accounts),
    • actions disrupting Service operation,
    • security breaches.
  6. If possible, before suspending or terminating the Contract, the Service Provider calls on the User to cease violations within a specified period.
  7. In case of Contract termination (including Account deletion at User request), the active subscription expires at the end of the paid billing period. Unused Limit is forfeited on the subscription end date. The above does not apply to cases where the law requires a refund (in particular, effective withdrawal from the Contract by the Consumer), in accordance with §12.

§6. Payments and Billing

  1. SRTing operates on a monthly subscription system. The User chooses a Plan (Starter, Pro, or Enterprise).
  2. Order and payment processing is handled by Paddle.com. Paddle is the official Merchant of Record for all our orders.
  3. Auto-renewal: The subscription renews automatically for subsequent Billing Periods unless the User cancels it before the end of the current period.
  4. Payments: The fee for the next Billing Period is charged in advance on the start date of the subsequent period (or another date indicated in the payment process).
  5. Cancellation: The User may cancel the subscription at any time in Account settings. After cancellation, the User retains access to the Service and remaining Limit until the end of the paid Billing Period, after which access to paid features expires.
  6. Unused Limit: The Limit is assigned to a specific Billing Period. Unused Limit seconds expire at the end of the subscription month and do not roll over to the next period (do not accumulate).
  7. Limit Usage: Usage is billed in a per-second billing model (accurate to the second). Billing includes the entire duration of the submitted audio material, not just segments containing speech. This means that silence, music, background noise, and other non-dialogue portions of audio are also counted toward Limit usage. For example: if a User processes a 30-second sequence where only 10 seconds contain speech – 30 seconds will be charged.
  8. The Enterprise Plan is offered based on individual terms (contract), and these Regulations apply to matters not regulated by the contract.
  9. Changing the Plan (upgrade/downgrade) may result in a change of Limit and price from the next Billing Period or immediately (taking into account appropriate settlements), according to information presented during the change process.
  10. The Service Provider issues VAT invoices in accordance with applicable regulations.

§7. Rights and Obligations

The User agrees to:

  • use the Service in accordance with applicable law and these Regulations,
  • not take actions aimed at bypassing security or billing systems,
  • not share Account access with third parties,
  • possess a legal license for Adobe Premiere Pro,
  • not provide the Service Provider with unlawful content (specifically in data provided during registration, support tickets, diagnostic logs, project names, or other text fields),
  • possess rights or consents necessary to use audio/video materials processed using the Service and bear liability for infringement of third-party rights resulting from the use of these materials,
  • ensure a stable working environment and save the project before starting the transcription process. The User acknowledges that interruption of the application or system operation may result in charging of used seconds.

The Service Provider agrees to:

  • provide the Service with due diligence,
  • ensure availability of the billing system,
  • protect User data in accordance with GDPR,
  • inform about planned technical breaks in advance (if possible).

§8. Liability and Limitations

  1. The Service Provider is liable for the proper operation of the billing system and cloud infrastructure.
  2. The Service Provider is not liable for:
    • transcription quality depending on source material quality,
    • data loss resulting from lack of backups on the User's side,
    • interruptions resulting from force majeure, DDoS attacks, or external provider failures,
    • technical errors lying solely on the side of the Payment Provider.
  3. The Service Provider is not liable for data loss, transcription process interruption, or charging of utilized seconds resulting from:
    • crashes, errors, or instability of Adobe Premiere Pro software,
    • failure of the operating system, User hardware, or environment in which the plugin or CLI module operates,
    • Service interruption caused by User actions (in particular manual interruption, closing the application, computer shutdown, or power loss),
    • failure to meet technical requirements or use of outdated plugin, CLI module, or Adobe software versions.
  4. In case of transcription process interruption for reasons beyond the Service Provider's control, seconds used up to the moment of interruption may be deducted from the User's Limit and are not subject to automatic refund.
  5. The above does not exclude Service Provider liability in cases where the transcription process interruption or incorrect second charging occurred for reasons lying solely on the Service Provider's side (e.g., bug in plugin code).
  6. For Users who are not Consumers, Service Provider liability is limited to the value of funds paid in the last 12 months.
  7. The above limitations do not apply to damages caused intentionally.
  8. Device liability limitation provisions apply to Consumers only to the extent permitted by mandatory applicable law.

§9. Personal Data Protection

  1. The Administrator of personal data is the Service Provider.
  2. Data is processed for the purpose of Service provision, billing, and communication with the User.
  3. Detailed information on data processing is contained in the Privacy Policy.
  4. User Audio is not uploaded to Service Provider servers – processing takes place locally.
  5. The Service Provider applies appropriate technical and organizational measures to protect data.

§10. Intellectual Property

  1. All copyrights and related rights to the SRTing Platform (source code, interface, algorithms) belong to the Service Provider.
  2. The User obtains a non-exclusive, non-transferable license to use the Service in accordance with the Regulations.
  3. Content generated by the User (transcriptions) remains the property of the User.
  4. The User does not have the right to decompile, reverse engineer, or modify the software, except to the extent permissible by mandatory applicable law.
  5. Adobe and Adobe Premiere Pro are trademarks of Adobe Inc. The Service Provider is not affiliated, sponsored, or endorsed by Adobe Inc., unless stated otherwise.

§11. Complaints

  1. Complaints can be submitted via email to contact@srting.com or in writing to the Service Provider's registered address indicated in §1.
  2. The application should contain: description of the problem, date of occurrence, Account email address.
  3. Complaints are considered within 14 days from the date of submission.
  4. In case of accepting the complaint, the Service Provider may restore used seconds or offer another solution.
  5. Digital Service Non-conformity (Consumers): With regard to Consumers (and Entrepreneurs with consumer rights), a complaint may concern non-conformity of the Digital Service with the Contract. First, the Consumer may demand bringing the Service into conformity with the Contract. If bringing into conformity is impossible or requires excessive costs, the Consumer may submit a statement on price reduction or withdrawal – under the rules resulting from the Consumer Rights Act.
  6. Out-of-court dispute resolution (ADR): The Consumer may use out-of-court methods of complaint consideration and claims assertion, in particular with the assistance of the locally competent Consumer Ombudsman or Trade Inspection. Use of ADR is voluntary and does not exclude the right to pursue claims in court.

§12. Withdrawal from Contract (Consumers)

  1. The Consumer may withdraw from the Contract within 14 days from the date of its conclusion without giving any reason.
  2. If the Consumer requested the commencement of Service provision before the expiry of the withdrawal period and subsequently withdraws from the Contract, they are obliged to pay for the performance fulfilled until the moment of withdrawal, proportionally to the seconds used within the Limit assigned to the current Billing Period.
  3. The refund covers the part of the fee corresponding to unused seconds of the Limit in the current Billing Period. The price of 1 second is calculated as the price paid for the Plan divided by the total Limit of seconds in that Plan.
  4. Free seconds granted promotionally (e.g., 300 s at start) are not refundable.
  5. The withdrawal statement can be submitted to the address: contact@srting.com
  6. The refund occurs within 14 days from receiving the withdrawal statement, using the same payment method used by the Consumer, unless the Consumer has expressly agreed to another method of return which does not involve additional costs for them.

Important: When purchasing a Subscription Plan, the User who is a Consumer consents to the commencement of Service provision (accessing the Limit) before the expiry of the withdrawal period. Giving this consent means acknowledging that in case of withdrawal, the Consumer will be obliged to pay for used seconds proportionally to the scope of fulfilled performance.

§13. Changes to Regulations

  1. The Service Provider reserves the right to change the Regulations for valid reasons (change of law, change of Service functionality).
  2. Users will be informed about changes with 14 days' advance notice via email.
  3. Continued use of the Service after changes enter into force may imply acceptance thereof, subject to the User's right to terminate the Contract. In case of changes significantly affecting User rights and obligations (e.g., prices, Limits, billing rules), the User has the right to terminate the Contract before the changes take effect.
  4. In case of lack of acceptance of changes, the User may terminate the Contract without incurring costs.
  5. Changes to Regulations do not infringe on acquired rights of Users, in particular they do not affect previously purchased Balance, unless the change results from mandatory applicable law requiring immediate implementation.

§14. Final Provisions

  1. In matters not covered by these Regulations, the provisions of Polish law shall apply, in particular the Civil Code, the Consumer Rights Act, the Act on Providing Services by Electronic Means, and GDPR.
  2. Disputes with Consumers shall be settled by a court having jurisdiction in accordance with applicable law. In disputes with Users who are not Consumers, the court having jurisdiction is the court competent for the Service Provider's registered office.
  3. If any provision of the Regulations is deemed invalid, the remaining provisions remain in force.
  4. The Regulations enter into force on the date of publication on the srting.com website.
